These Terms of Sale apply to every order placed on mysterypak.com. By placing an order you agree to them, together with our Refund & Returns Policy and our Privacy Policy. Please read them before you pay.

What you are buying

A Mystery Pak is a sealed blind box. Each box contains one serial-numbered video game cartridge and one trading card matching that cartridge's color and number. The color and the serial number inside any given box are random and are not selected by you, are not disclosed before purchase, and cannot be requested, exchanged or reserved. Every box is personally autographed by Jason Paige and verified by 151 Authentic before being shrink-wrap sealed. Product photography shows the range of colors in the series; it is not a promise of which color you will receive.

An optional protective hard clam-shell case is offered as a separate line item and can be removed from your cart before checkout.

Price, taxes and payment

Prices are shown in US dollars and are the prices in effect at the time you place your order. The item price, the shipping charge and the final total are all shown on the secure payment page before you authorize payment. Payment is processed by our payment processor; we never receive or store your full card details. We do not display comparison, "was/now" or discounted pricing.

Purchase limit

To keep the release fair, there is a lifetime limit of 2 units per customer and per household, counted across all orders and all shipping addresses associated with you. If an order exceeds that limit, or if the release sells out between your payment and our processing of it, we will cancel the affected order and refund it in full to your original payment method.

Order acceptance

Your order is an offer to buy. We accept it when we ship it. Until then we may decline or cancel any order — for example for suspected fraud, a pricing or stock error, an unserviceable address, or a breach of the purchase limit — and we will refund you in full if we do.

Shipping and delivery

Shipping daily. Orders are packed and handed to the carrier on business days, normally within one to two business days of payment. We ship to the United States and Canada only. Shipping is fully insured and is charged at checkout:

• United States — UPS Ground, fully insured — $29.00 — 2 to 5 business days
• Canada — UPS Standard, fully insured — $49.00 — 4 to 10 business days

Carrier delivery windows are estimates, not guarantees, and start when the carrier receives the parcel. Customs duties, import taxes and brokerage fees on Canadian shipments are the recipient's responsibility. You will receive a shipment notification with tracking as soon as your parcel is on its way, and you can check status any time via Order Lookup.

Title and risk of loss

Title and risk of loss pass to you on delivery of the parcel to you by the carrier. Because every shipment is fully insured, a parcel lost or damaged in transit is covered — see the Refund & Returns Policy for how to make a claim.

Returns

All sales are final. Because this is a sealed, autographed, serial-numbered limited-edition collectible, we do not accept change-of-mind returns or exchanges. Items damaged in transit, defective, incorrect or undelivered are covered — the full details, claim window and process are in the Refund & Returns Policy.

Warranty disclaimer

The product is a collectible sold as-is. Except for the rights described in our Refund & Returns Policy and any rights you have under applicable consumer law that cannot be waived, we make no warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Vintage cartridges are pre-owned hardware and are sold as collectibles; play performance is not warranted.

Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential losses, including lost resale or investment value. Nothing in these terms limits liability that cannot be limited by law. Nothing here affects your statutory consumer rights.

Trademarks

Mystery Pak ™ is a blind box product that is not affiliated with, owned or operated by Nintendo, Game Boy, Game Freak, Creatures or The Pokémon Company. All third-party names and marks are the property of their respective owners and are used only to describe pre-owned hardware.

Disputes and governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Before starting a payment dispute or chargeback, please contact us at info@mysterypak.com — most issues are resolved within one business day, and we would rather fix the problem than fight about it.

Changes to these terms

We may update these terms. The version in effect when you place your order is the version that applies to that order, and the version you agreed to is recorded with your order.
